It said an officer discharged his weapon, that ICE officers immediately rendered aid and that more information would be shared.

Gothamist (opens in a new tab) reported that DHS did not say what prompted the officer to fire or address the report that a child was in the vehicle. CNN, citing a law enforcement source, reported that the man is 28, that his record includes a 2023 robbery arrest to which he pleaded guilty to a reduced charge of grand larceny, with five years of probation, and that he has a pending indictment for the sale of a controlled substance. The source also said two agents were injured, and a federal official said one may have been injured in a car accident, though it was unclear whether the accident was part of the attempted arrest or the response.

What officials and witnesses described

Mayor Zohran Mamdani said early reports indicated agents surrounded the man and his 5-year-old child in his car before firing multiple rounds, and that he believed the child was physically unharmed. A law enforcement official told CNN the agents shot into the vehicle with the child in the back seat. Council Member Pierina Sanchez, who represents the area, told Gothamist she had heard reports that agents fired through the windshield and that as many as seven shots were heard; Gothamist did not independently verify those reports. Orlando Perez, who lives in a building at the scene, told Gothamist he saw people wearing vests fire at a car as it tried to drive away. The Intercept (opens in a new tab) quoted a neighbor, Iris Rosa, who said a man in a high-visibility vest appeared to be posing as a construction worker and put the vest in a nearby vehicle after the shooting. CNN reported that witnesses told police they saw a man in a bright yellow construction vest holding a gun and heard five to six gunshots.

The accounts differ on whom the operation targeted. DHS said the man shot was the target, and CNN, citing a law enforcement source, reported that agents encountered a person they were targeting. PIX11 (opens in a new tab) reported that its sources earlier said agents were trying to take someone into custody when another person who was not the focus of the arrest was shot, and noted that DHS's statement conflicted with that report.

Investigation and official responses

HSI responded to take over the investigation, a federal source told CNN. Rep. Adriano Espaillat said federal agents did not let him see the man at the hospital, The Intercept reported. Gov. Kathy Hochul said she expects federal authorities to provide "a full and transparent accounting." Council Speaker Julie Menin said she was "deeply concerned" and called for a fully transparent account without delay. Mamdani said he had called the President and would demand that he end all ICE enforcement actions in the city when they spoke; according to CNN, a spokesperson for the mayor said the two had not spoken as of Thursday evening.

Three days earlier, eight elected officials, including Sanchez, Council Members Carmen De La Rosa and Eric Dinowitz and Rep. Espaillat, wrote to Kingsbridge Associates, urging the company and Target to prohibit ICE agents from using the parking lot at 40 West 225th Street as a staging area, Gothamist reported. ABC News (opens in a new tab) reported that city officials had been told ICE was using that lot. A Target spokesperson told Gothamist the shooting was not on or adjacent to Target property and that the company has no agreement with ICE. Gothamist reported it was not immediately clear whether the shooting had any relation to that activity, and Sanchez said the shooting occurred near the location where ICE agents have reportedly been staging.
