Was ICE justified in shooting a man in a car in Marble Hill?

An ICE officer shot a man in a car in Marble Hill on October 8. DHS calls it a targeted arrest and had not said by October 9 why the officer fired. Mamdani says early reports indicate agents surrounded the man and child before firing.

Claim in dispute

An ICE officer fired during a targeted enforcement operation to arrest a man with a criminal record, and sanctuary policies that released him in 2023 created the dangerous conditions.

Overview

This case classifies responses to the ICE officer's shooting of a man in a car in Marble Hill on October 8, 2026, not the man's criminal record, his immigration status or the broader dispute over ICE enforcement in New York City.

What the accounts agree on

An ICE officer fired during an encounter around 4 p.m. near West 225th Street and Marble Hill Avenue, and the man was hurt. DHS said an officer discharged his weapon and the man was injured, and the NYPD said he was conscious at a nearby hospital. CNN (opens in a new tab), citing a law enforcement source, reported that his injuries included a graze wound to the neck and were not considered life-threatening. The NYPD said it was not involved and was not on scene when the shooting happened. DHS said Homeland Security Investigations and the FBI were at the scene and that the incident remains under investigation.

The federal account

In a statement posted on X, DHS said ICE officers were conducting a targeted enforcement operation in the Bronx to arrest a man from the Dominican Republic with a prior conviction for grand larceny and multiple prior arrests for assault, robbery, drug possession and weapons possession. DHS said he has associations to the Trinitarios gang, that the NYPD arrested him on December 7, 2023, and that he was released a few days later by "reckless Democrat sanctuary policies." It said an officer discharged his weapon, that ICE officers immediately rendered aid and that more information would be shared.

Gothamist (opens in a new tab) reported that DHS did not say what prompted the officer to fire or address the report that a child was in the vehicle. CNN, citing a law enforcement source, reported that the man is 28, that his record includes a 2023 robbery arrest to which he pleaded guilty to a reduced charge of grand larceny, with five years of probation, and that he has a pending indictment for the sale of a controlled substance. The source also said two agents were injured, and a federal official said one may have been injured in a car accident, though it was unclear whether the accident was part of the attempted arrest or the response.

What officials and witnesses described

Mayor Zohran Mamdani said early reports indicated agents surrounded the man and his 5-year-old child in his car before firing multiple rounds, and that he believed the child was physically unharmed. A law enforcement official told CNN the agents shot into the vehicle with the child in the back seat. Council Member Pierina Sanchez, who represents the area, told Gothamist she had heard reports that agents fired through the windshield and that as many as seven shots were heard; Gothamist did not independently verify those reports. Orlando Perez, who lives in a building at the scene, told Gothamist he saw people wearing vests fire at a car as it tried to drive away. The Intercept (opens in a new tab) quoted a neighbor, Iris Rosa, who said a man in a high-visibility vest appeared to be posing as a construction worker and put the vest in a nearby vehicle after the shooting. CNN reported that witnesses told police they saw a man in a bright yellow construction vest holding a gun and heard five to six gunshots.

The accounts differ on whom the operation targeted. DHS said the man shot was the target, and CNN, citing a law enforcement source, reported that agents encountered a person they were targeting. PIX11 (opens in a new tab) reported that its sources earlier said agents were trying to take someone into custody when another person who was not the focus of the arrest was shot, and noted that DHS's statement conflicted with that report.

Investigation and official responses

HSI responded to take over the investigation, a federal source told CNN. Rep. Adriano Espaillat said federal agents did not let him see the man at the hospital, The Intercept reported. Gov. Kathy Hochul said she expects federal authorities to provide "a full and transparent accounting." Hochul later posted that she spoke with President Trump and DHS Secretary Mullin, expressed outrage on behalf of New Yorkers and urged them to halt ICE enforcement operations in New York. Council Speaker Julie Menin said she was "deeply concerned" and called for a fully transparent account without delay. Mamdani said he had called the President and would demand that he end all ICE enforcement actions in the city when they spoke; according to CNN, a spokesperson for the mayor said the two had not spoken as of Thursday evening. Later that night, Mamdani said he spent two hours on the phone with President Trump and DHS Secretary Markwayne Mullin seeking the man's release, that the talks were unsuccessful and that ICE took the man away in an unmarked vehicle, CBS New York (opens in a new tab) reported. At a press conference, NYPD Commissioner Jessica Tisch said NYPD cameras did not capture the shooting but that evidence collected at the scene indicates at least one ICE agent discharged seven rounds, striking the driver in the neck, and that officers who arrived found men in construction-style vests and face masks, at least one carrying a long gun. She said federal agencies have taken over the investigation.

Three days earlier, eight elected officials, including Sanchez, Council Members Carmen De La Rosa and Eric Dinowitz and Rep. Espaillat, wrote to Kingsbridge Associates, urging the company and Target to prohibit ICE agents from using the parking lot at 40 West 225th Street as a staging area, Gothamist reported. ABC News (opens in a new tab) reported that city officials had been told ICE was using that lot. A Target spokesperson told Gothamist the shooting was not on or adjacent to Target property and that the company has no agreement with ICE. Gothamist reported it was not immediately clear whether the shooting had any relation to that activity, and Sanchez said the shooting occurred near the location where ICE agents have reportedly been staging.

What remains unresolved

As of October 9, 2026, we could not locate a public identification of the officer, a release of official video of the shooting, or a statement from DHS about what prompted the officer to fire. Tisch named the man at her press conference, but the NYPD could not confirm the spelling and deferred to DHS.

At a press conference near the scene, Mayor Zohran Mamdani said there is no explanation for federal officers firing this many rounds into a car with a five-year-old in it. He asked how it keeps anyone safe to have individuals in construction vests and masks with long guns, whom residents cannot identify as law enforcement.

    Before the statement

Mamdani spoke late Thursday, hours after the shooting, alongside NYPD Commissioner Jessica Tisch, whom he refers to in the remarks.

    After the statement

Asked about his message to the President, Mamdani said he made clear to the president and the secretary his request that ICE agents leave the scene entirely and that ICE stop its enforcement actions in New York City, Mediaite reported.

    Why this label?

The reference point is whether the ICE officer was justified in shooting the man in the car. Mamdani says there is no explanation for federal officers firing this many rounds into a car with a five-year-old in it, which rejects the shooting as justified, so we labeled it Condemned. The closest competing label is Challenged the characterization, which would fit a dispute with DHS's account of a targeted arrest; he rejects the firing itself and the tactics.

This label describes the statement's response within the context above.

It said officers are forced to make arrests in dangerous environments when sanctuary politicians release such people.

    Before the statement

DHS issued the statement about four hours after the shooting. PIX11 reported that its sources had earlier said agents were trying to take someone into custody when another person who was not the focus of the arrest was shot.

    After the statement

DHS statement on the October 8 shooting in the Bronx (X post)First paragraph of the post, October 8, 7:55 p.m. EDT.

    Why this label?

The reference point is whether the ICE officer was justified in shooting the man in the car. DHS describes a targeted arrest of a man with a criminal record and says officers must make such arrests in dangerous conditions because of sanctuary policies, which supports the officer's conduct without saying why he fired, so we labeled it Defended or excused. The closest competing label is Explicitly stayed out, since the statement says the incident remains under investigation and does not address what prompted the shot; it loses because the statement goes on to defend the operation and assign the danger to local policy.

This label describes the statement's response within the context above.
