Overview

Michigan gubernatorial candidate and U.S. Rep. John James said in an August 27, 2026 podcast interview with Benny Johnson that FBI Director Kash Patel privately told him the FBI would have a presence in Michigan before Election Day. At a September 15, 2026 Senate Judiciary Committee oversight hearing, Sen. Peter Welch put that claim to Patel directly. This case covers only that exchange. A related but separate exchange at the same hearing, about the FBI’s hiring standards, is a distinct case. Official hearing record (opens in a new tab).

    1. John James says Patel told him the FBI will have a presence in Michigan before Election Day

      Claim

Michigan gubernatorial candidate and Representative John James said in a podcast interview with Benny Johnson that he had spoken with FBI Director Kash Patel, and that Patel had told him the FBI would have a presence in Michigan in the run-up to Election Day, in both West Michigan and Southeast Michigan. The claim was the basis for the questioning Patel later faced in the Senate. Neither Patel nor the FBI has confirmed the conversation took place as James described it.

  2. September 2026

    1. Patel is pressed at a Senate Judiciary oversight hearing and declines to rule out agents at the polls

      Incident

At a Senate Judiciary Committee oversight hearing lasting about five hours, Democratic senators pressed FBI Director Kash Patel on whether the bureau would send agents to polling places in the November midterm elections. Patel described an FBI "election crimes" structure operating from field offices and told Senator Amy Klobuchar he would follow the law barring agents from being deployed inside polling places on Election Day. Asked by Senator Richard Blumenthal whether sending agents to the polls would be unlawful, Patel said "I don't know that we can't legally do it." Asked by Senator Peter Welch to pledge that the FBI would not interfere with the election, Patel did not give that pledge and told Welch he would not participate in what he called a charade of lies. Blumenthal said he was dissatisfied that Patel would not give an unequivocal commitment.

    2. Rep. Krishnamoorthi asks Attorney General Blanche about FBI presence at polling places

      Reaction

On September 17, 2026, Rep. Raja Krishnamoorthi (D-IL) wrote to Attorney General Todd Blanche after Patel's Senate testimony. The letter asks whether the Justice Department has a written policy barring FBI agents from polling places absent a specific report of a federal crime, whether that policy has changed, whether Patel or any other Department or FBI official told John James or any other candidate that FBI personnel would have a presence in specific areas of Michigan or another state, and whether the Department will commit that no FBI personnel will be stationed at polling places during voting hours. It requests a written response by September 24.

    Before this statement

Welch, reacting to Patel’s coordinators answer, said "I thought you weren’t going to be sending people to the polls" and then asked Patel directly to pledge the FBI would not interfere with the November elections.

"When did you hear that? It’s just another lie... I have pledged unequivocally that I will not participate in your charade of lies."

Case context: Patel questioned on FBI presence at Michigan polling places after John James claim

    Full statement and sources

Kash Patel declined to give Sen. Peter Welch a direct pledge against FBI election interference, calling the request "a charade of lies."

    After the statement

Sen. John Cornyn, who had taken over the gavel from Chairman Grassley, intervened to tell the two senators to "knock it off."

    Why this label?

When Welch asked Patel to "pledge that you will not in any way interfere in the will of the American people when they go to the polls," Patel did not answer yes or no. Instead he called the question "just another lie" and said he had "pledged unequivocally that I will not participate in your charade of lies" — refusing to give the requested pledge rather than answering it.

This label describes the statement's response within the context above.

  2. Kash PatelFBI DirectorDirectly involved

    Before this statement

Asked directly by Sen. Peter Welch at the September 15, 2026 Senate Judiciary Committee hearing: "Last month... John James said to podcaster Benny Johnson... ‘the FBI will have a presence leading up to Election Day in Michigan, in both West Michigan and Southeast Michigan.’ Is that true?"

"We have an election crimes community coordinator in all 56 field offices, so you bet we’re going to have them there and manning the posts for election interference matters."
    Challenged the characterization

Responding to: Kash Patel privately told John James that the FBI will have a presence leading up to Election Day in Michigan, in both West Michigan and Southeast Michigan.

    Full statement and sources

Kash Patel responded to a question about John James’s claim by describing standing FBI election-crimes coordinators in each field office, without directly confirming or denying the specific Michigan claim.

    After the statement

Welch followed up by contrasting this answer with Patel’s earlier, more hedged answer to Sen. Blumenthal in the same hearing about whether sending FBI agents to the polls would be illegal.

    Why this label?

Patel neither confirms nor denies James’s specific claim about a Michigan presence; he recharacterizes the matter as standing "election crimes community coordinators" present in all 56 field offices for "election interference matters," rather than a new or targeted deployment. This disputes the framing of James’s claim without a clear affirmation or denial. It is a close call, since his answer could also be read as an implicit confirmation.

This label describes the statement's response within the context above.

Correction to: Statement by Richard Blumenthal

Corrected language
Well, I'm dissatisfied that you are unable to give us an unequivocal, clear, unambiguous commitment that the FBI will be kept out of election interference.

The recorded quotation attributed two sentences to Sen. Richard Blumenthal, but the first was spoken by FBI Director Kash Patel. At the September 15, 2026 Senate Judiciary Committee oversight hearing, Blumenthal asked whether deploying FBI agents to the polls on Election Day would be contrary to law, and Patel answered “I don’t know that we can’t legally do it.” Only the second sentence is Blumenthal’s, and its opening words were also dropped. The record’s neutral summary already attributed the line correctly to Patel; the quotation field did not, so the page read as though Blumenthal had said both. Checked against the committee’s own recording of the hearing and corroborated by ABC News, Democracy Docket and Government Executive, which all attribute the sentence to Patel.

This corrects our account of what happened.
