Overview

The FCC's April 28 order required eight ABC-owned local television stations to apply for renewal years before their licenses would ordinarily expire. It did not revoke those licenses, and it did not call every ABC affiliate for review.

Disney and its station plaintiffs allege that the employment-discrimination inquiry is a pretext for punishing ABC's programming and journalism. They argue that the threat to their licenses is already affecting editorial choices. The FCC disputes retaliation and says early renewal is authorized after deficient responses to its inquiry. It also says the stations can keep operating while the process continues. These are competing legal arguments, not findings that Disney discriminated or the agency retaliated.

America First Legal supports the FCC's authority and opposes an injunction. FIRE and the Reporters Committee argue that the proceeding violates free-expression protections. Commissioner Anna Gomez condemns the threat as disproportionate. Markey, Cantwell, Schumer and Lujan called for the order to be rescinded in a joint letter.

A separate procedural dispute concerns the court's power to hear the case now. The government says Congress directs review through the courts of appeals after agency action. Disney says a present constitutional injury warrants district-court intervention. At the October 6 hearing, Judge Loren AliKhan did not immediately rule.
