Overview

Domestic-violence service coalitions challenged DOJ's grant certification and funding restrictions, alleging unlawful pressure on services and speech. DOJ defended its authority and nondiscrimination requirements. A September 29, 2026 judgment set the challenged conditions aside under the APA; DOJ acknowledges the vacatur.

Read the full background

A coalition of service organizations sued DOJ in June 2025 over conditions attached to domestic-violence assistance funding. The disputed certification refers to programs that violate federal civil-rights or nondiscrimination laws, including programs with DEI components. Its text does not prohibit all DEI programs. The plaintiffs argue that the certification and related restrictions threaten services and expose providers to uncertain False Claims Act liability.

In its July 8, 2026 brief, DOJ argued that the certification reflected longstanding OVW nondiscrimination obligations. It defended its discretion to impose the conditions, disputed the plaintiffs' standing and APA theories, and argued that its explanation was adequate.

On September 29, 2026, Judge Melissa DuBose set aside the challenged conditions as arbitrary and capricious. The court did not decide the remaining constitutional theories and declined to permanently prohibit future conditions under all circumstances. DOJ's FY2026 OVW page, updated October 23, says Condition 15 is vacated and unenforceable unless the judgment is stayed or overturned. The related HHS/HUD case concerns different agencies and a separate judgment.
