Overview
ICE agents arrested Almonte on Decatur Avenue and Concepcion on Hull Avenue in the Norwood section of the Bronx on May 6, 2026. Videos of both arrests circulated online, and Concepcion, who was walking to a barbershop, needed stitches. ICE said it had been looking for another man and mistook Almonte for him.
Almonte petitioned the U.S. District Court for the Eastern District of New York for release, and Judge Gary R. Brown released him on bond after a factual hearing on June 26. In his October 5 ruling, Brown found that the man agents said they were seeking was five inches shorter and 80 pounds lighter than Almonte, that database checks run before the warrant was issued came back negative, and that the officers' testimony about seeing Almonte sell drugs did not appear in their own arrest records and was apparently perjurious. He ordered the government to report within 21 days on steps to ensure lawful enforcement and raised the possibility of sanctions.
DHS said in May that Concepcion was not arrested by ICE. After the ruling, a DHS spokesperson said the matter would be litigated in court. WIRED and THE CITY identified Brenden Cuni, the supervisory officer whose warrant the ruling calls fraudulent, at the scene of the October 8 ICE shooting in Marble Hill; Newsweek reported that his role there, if any, remained unclear.
