Overview

Vice President JD Vance accused Microsoft on October 8, 2026 of replacing laid-off American workers with foreign workers. At a press conference, he cited 6,000 layoffs, 6,300 H-1B visas and almost 3,000 green cards. He treated the immigration figures as replacements for the employees who lost their jobs. Microsoft challenged that comparison. The company said 80% of roughly 6,000 H-1B applications in its last fiscal year extended or changed the status of existing employees. It said the remainder concerned people already legally in the United States who joined Microsoft, and that these new hires amounted to 1% of its U.S. workforce. The dispute turns on replacement, not simply whether layoffs and immigration filings occurred in the same period. Existing-worker petitions are not new hires. Aggregate figures also do not identify which jobs, workers or business units were affected. The record cited by Vance does not itself establish those connections.
