Judge clears former FEMA CFO Mary Comans, rules officials' 2025 accusations were false
A magistrate judge ruled that DHS statements, an Elon Musk post and information officials gave Laura Loomer falsely accused former FEMA CFO Mary Comans in February 2025. The government did not contest the facts and has appealed the underlying ruling.

Overview
DHS fired Comans and three other FEMA employees on February 11, 2025, saying they had circumvented leadership to make payments for New York City hotels housing migrants. The same day, Elon Musk called her firing a criminal action in a post, and Laura Loomer posted that she had illegally funded hotels for migrants.
Comans sued. In July 2026 District Judge Michael S. Nachmanoff ruled that she was fired without due process and ordered a name-clearing hearing. The government did not object to her proposed facts, and Magistrate Judge William E. Fitzpatrick's October 13 order found the accusations objectively and demonstrably false, that officials who made them knew they were false, and that then-Secretary Kristi Noem and Corey Lewandowski supplied the information Loomer posted. The government has appealed the July ruling to the Fourth Circuit.

What's disputed
Disputed claim
U.S. Department of Homeland Security
FEMA fired four employees, including its chief financial officer, for circumventing leadership to unilaterally make egregious payments for luxury New York City hotels for migrants.
What is disputed
The DHS statement identified the fired employees by job title, and Comans was FEMA's chief financial officer. The October 13, 2026 order found that apart from the firing, the statement was entirely false and that FEMA and DHS officials knew it was false when it was made. The government did not object to those facts.

Disputed claim
Mary Comans' firing for funneling $58 million to migrant hotels in Manhattan reflected a criminal action.
What is disputed
Musk added the words A criminal action to a quoted post about Comans. The October 13, 2026 order found that apart from the firing, his post was entirely false, that he knew or should have known his own subordinates had approved the payments, and that posting her picture was little more than state sanctioned intimidation.
