Was Kathy Hochul right to appoint Letitia James as special prosecutor in the Cornell case?
Hochul says James will provide an independent investigation of the alleged Cornell sexual assault. Ziegler objects to the appointment, and Ryan questions whether James's earlier public comments compromise her impartiality.
Claim in dispute
Appointing Attorney General Letitia James will ensure an independent investigation of the Cornell allegations without conflict or bias.

Overview
Hochul's October 1 executive order assigns James the criminal investigation and any resulting prosecution under Executive Law 63(2). It supersedes the Tompkins County district attorney in the covered matters. Hochul says concerns about the earlier investigation and decision not to prosecute require this intervention.
Ziegler denounces the appointment as politically driven. Ryan argues that James's September 28 message to the complainant suggests prejudgment. James says the investigation will be guided by the facts and the law.
The question here is whether Hochul's choice of James is justified and can deliver the independence she promises. Cornell's campus sanctions are addressed in the related Cornell disciplinary case (opens in a new tab). The order authorizes an investigation and conditional prosecution; it does not decide the allegations.
