Texas Governor-elect Gina Hinojosa vows to pause new data center approvals until lawmakers pass protections
Texas Governor-elect Gina Hinojosa says she will pause new data center approvals until the Legislature passes protections for Texans. The Data Center Coalition says its members will keep building, and Trump says he will work with states that want the projects.

Case period:
Published by The Dispute Index editorial teamPublished Updated
Overview
Texas has become one of the largest markets for data center construction. Gov. Greg Abbott, who in November 2025 called Texas the epicenter of AI development, halted new data center connections to the state grid on August 3, 2026 and ordered an audit of the projects. On September 21 he directed the Texas Commission on Environmental Quality to issue no permits sought by data center projects until the grid and water audits were complete. Hinojosa called on Abbott in July to order a moratorium until the Legislature met, and she later called his measures an election-year pause. She defeated Abbott on November 3 and takes office on January 19, 2027, alongside a Democratic-majority Texas House.

Tapper tells Hinojosa that AI investors are said to be worried about her victory given her promises of a temporary data center moratorium, and cites CNN voter polls showing voters in her race opposed building data centers in their communities, 75 percent to 25 percent. Defended or excusedResponding to: Gina Hinojosa says that as governor she will issue a moratorium on all data center approvals in Texas until the Legislature passes laws to protect Texans.
Full statement and sources
Asked how she will weigh investors' worries about her promised temporary data center moratorium, Hinojosa says data centers have moved into mostly rural communities with no rules or laws to protect Texans, and that the state needs to stop what it is doing with data centers until it has those protections.
After the statement
Hinojosa says Texas can have a strong economy, strong industry and protections for its people. Asked whether data centers could still be built, she says communities need a seat at the table to decide if and how they come in, and that it is not that she hates data centers but the way they are taking advantage of Texas.
