Role at the time: FBI director
Statement summary
Patel says Floris and Benavides both testified that the task force was not involved in the Hunter Biden investigations, and that documentary evidence, communications and witness accounts contradict that testimony.
“Documentary evidence, contemporaneous communications, and witness accounts contradict their testimony”
Patel's account of documentary contradictions is an allegation, not a finding of guilt.
The reference point is the alleged knowing and material false testimony. Patel accuses the former officials of giving answers contradicted by the records.
Role at the time: Director of the FBI, in an interview on Fox News
Statement summary
In a Fox News interview with Sean Hannity, FBI Director Kash Patel said that prior Justice Department and FBI leadership subpoenaed eight sitting senators, put the information in a lockbox, put the lockbox in a vault and put the vault in a place where no one could see or search the files. He said the FBI found the information to expose the politicization by Jack Smith and the prior Justice Department. Earlier in the interview he said FBI agents do their job when they are not forced to politicize law enforcement, lie to federal courts, get secret search warrants and spy on members of Congress.
“you don't force them to politicize law enforcement and lie to federal courts to attack your political opponents and get secret search warrants and go spy on members of Congress ... They took this information where they subpoenaed eight sitting United States senators, put it in a lockbox, put that lockbox in a vault, and then put that vault in a cyber place where no one can see or search these files. ... We found this information to expose the politicization by Jack Smith and the prior Department of Justice.”
Fox News video of FBI Director Kash Patel's interview with host Sean Hannity, posted October 7, 2025. Patel answered a question about the FBI's handling of records on eight senators.
Archived copy (opens in a new tab)Patel described the records of eight sitting senators as gathered and then hidden by prior leadership, and said the FBI found them "to expose the politicization by Jack Smith and the prior Department of Justice." He also said agents should not be forced to "go spy on members of Congress." That criticizes the collection as improper and politicized, so we labeled it Condemned.

Role at the time: FBI Director, testifying at the Senate Judiciary Committee's FBI oversight hearing
Response to this claim
The fired employees exercised poor judgment and a lack of impartiality in carrying out their duties, leading to the political weaponization of the government.
“for the simple fact of working on those investigations? No. If they weaponize law enforcement, yes.”
PBS NewsHour video of Sen. Adam Schiff questioning FBI Director Kash Patel about the agents who worked on the Mar-a-Lago and January 6 investigations, at the Senate Judiciary Committee's FBI oversight hearing on September 15, 2026.
Archived copy (opens in a new tab)The reference point is the FBI's February 2026 firing of employees who worked on the investigation of Donald Trump's retention of classified documents. Patel says no agent was fired for the simple fact of working on the Trump investigations and that those who weaponized law enforcement were, which defends the firings as a response to misconduct.
Role at the time: FBI director
Statement summary
FBI Director Kash Patel defended the bureau's case-by-case use of Flock data, saying license-plate records helped identify a shooting suspect and locate kidnapped children.
“They collect information, not the FBI, where there is no reasonable expectation of privacy, basically publicly available information.”
Full hearing recording includes Cornyn's question about public criticism of license-plate readers and Patel's response defending case-by-case FBI use.

Response to this claim
The FBI’s hiring-standards change was designed to protect trafficking and sexual-abuse victims from automatic disqualification, and does not admit applicants who voluntarily engaged in the disqualifying conduct.
“We did not want to punish victims of bestiality, victims who were trafficked... Applicants who have engaged in bestiality means they were victims of bestiality because they were forced to do so.”

Response to this claim
Kash Patel landed in Russia on October 14, 2026, for a meeting scheduled to take place there.
“MS NOW just reported I had "landed in Russia" for meetings with the FSB. The same outlet constantly tells lies about this FBI and law enforcement's historic achievements in safeguarding the American people.”
Post by Patel on X responding to MS NOW's report that he had landed in Russia for meetings with the FSB. It lists FBI arrest and seizure figures and says the outlet owes an apology to the FBI, law enforcement and the American people.
Archived copy (opens in a new tab)MS NOW reported that Patel had landed in Russia. Patel calls the outlet's reporting lies and says it owes an apology, rejecting the report, so we used denies.
Patel presents the network as a useful investigative tool and defends its use subject to lawful access.
Patel directly argues the policy change is justified: it exists to avoid punishing trafficking and abuse victims, not to permit voluntary misconduct, an express defense of the conduct under scrutiny (the policy change).
