Noem says "There are no plans to have ICE officers at our polling locations"

Kristi NoemSecretary of Homeland Security, testifying at a Senate Judiciary Committee oversight hearing

Asked at a Senate Judiciary Committee hearing whether she would rule out deploying ICE or CBP to polling places in November, Noem said, "There are no plans to have ICE officers at our polling locations". Pressed to say it would not happen, she asked whether the senator planned on illegal aliens voting and said, "unless you plan on illegal aliens voting".

“There are no plans to have ICE officers at our polling locations. … Okay, then there should be no need to, unless you plan on illegal aliens voting. … We have no plans to have ICE officers or law enforcement at polling locations.”

Where this statement fits

Should ICE and other armed federal agents be allowed at or near polling places in the 2026 election?

Since February 2026, federal officials have given differing answers about whether ICE and other armed federal agents could be at or near polling places during the November 3 election. On September 1, Homeland Security Secretary Markwayne Mullin said ICE would be at a polling place only if there is a threat to it or agents are serving a warrant, and DHS told Politico that ICE is not planning operations targeting polling locations but that arrests could result if an active public safety threat endangered one. On September 10, 18 and 23, 2026, LULAC and other groups, a coalition including the NAACP, and Democratic leaders and party committees sued separately in federal court in Washington. They allege that the administration's statements and actions violate 18 U.S.C. 592, Section 11(b) of the Voting Rights Act, or both. As of September 25, the court dockets show no motion for a preliminary injunction and no answer or motion to dismiss from the federal defendants, and no court has ruled.

About this source

Democracy Docket's report of Noem's answers to Sens. Chris Coons and Alex Padilla at the March 3 hearing. It says Noem did not explicitly rule out a deployment and quotes her asking Coons whether he planned on illegal aliens voting. It names Coons as the senator who asked the question.

Before the quotation

Sen. Chris Coons (D-Del.) told Noem that Steve Bannon had recently said ICE should be deployed at the polls in the next election and asked whether she would rule out deploying ICE or CBP to polling places in November.

After the quotation

Coons then asked whether she was familiar with the federal statute on sending armed men to polling places and whether she would issue a directive that ICE and CBP be nowhere near polling places this November. Noem said, "We have no plans to have ICE officers or law enforcement at polling locations".

How this statement is classified

Mixed or conditional

The label describes this statement's response within the context above.

Why this label?

The reference point is the administration's stated or threatened use of ICE and other armed federal agents at or near polling places in the 2026 election. Noem said there are no plans to have ICE officers at polling locations but did not agree to rule it out, and tied the need for a presence to whether illegal aliens vote. A denial paired with that condition fits mixed or conditional better than denies, and explicitly declines loses because she did answer that there are no plans.
