Overview

The fixed reference point for classification in this case is President Trump's announcement, in a Truth Social post (opens in a new tab) at 3:04 PM EDT on Friday, September 18, 2026 and reaffirmed on camera in the Oval Office that afternoon, that he is "banning" CNN, MS NOW and Politico from the White House because of their coverage. In the White House video of the Oval Office event (opens in a new tab), Trump said he does not want the outlets "in my office" or "here," that "the ban would go as far as you can," and that he would "love it" if they "could straighten themselves out." Asked what "others to come" meant, he called the New York Times and the Washington Post "fake news" and said the White House had not "taken the step of throwing them out." CNN reported (opens in a new tab) that the White House press office, asked for comment, referred to those remarks. On Saturday, September 19, MS NOW, CNN and Politico said their White House reporters were refused entry and had press passes confiscated, as reported by MS NOW (opens in a new tab), CBS News (opens in a new tab) and ABC News (opens in a new tab). CNN reported (opens in a new tab) that all three outlets "signaled they will take legal action," and CBS News reported that the White House referred it to Trump's comments.

In February 2025 the White House excluded the Associated Press from the Oval Office and press-pool events; officials said the reason was the AP's continued use of "Gulf of Mexico." On June 6, 2025 a D.C. Circuit panel stayed most of the resulting injunction (opens in a new tab), leaving it in force only for the East Room. Judge Rao's concurrence, joined by Judge Katsas, reasons that the White House may consider viewpoint in admitting journalists to restricted spaces such as the Oval Office but may not exclude journalists on that basis from press facilities open to journalists generally, such as the briefing room; Judge Pillard would have denied the stay. That order decided a stay motion, not the merits; the appeal was argued on November 24, 2025 (opens in a new tab) and was still described as ongoing (opens in a new tab) on September 19.

The post also describes Politico as the recipient of an "$8 Million Dollar subscription" "directly from the United States Government." Politico's statement (opens in a new tab) says claims that it "received government subsidies are false and have been thoroughly debunked." Whether and how such payments were made is a separate factual question that this case does not adjudicate. Silence is not a position.
