The public accounts agree that federal officers were looking for different men associated with a similar white van, later surrounded Salgado Araujo’s van and that one officer fired a shot that struck him. He died at a hospital. They disagree about the movement of the vehicles, the officer’s position and whether Salgado Araujo posed an imminent threat when the shot was fired.
ICE maintained that Salgado Araujo evaded officers, rammed an agency vehicle, ignored commands and tried to run over an officer, causing the officer to fire in self-defense. That account is preserved in contemporaneous reporting (opens in a new tab) and was repeated by an ICE spokesperson in The Texas Tribune (opens in a new tab).
The passenger accounts conflict with that justification. The Texas Tribune (opens in a new tab) reported that Daniel Tirado Pantoja wrote that agents were never in front of the van and that Salgado Araujo had stopped when officers fired. José Trinidad Rojas Pliego wrote that the passengers told Salgado Araujo to stop, that he did so and that the officer then shot him. Tirado also alleged that an ICE vehicle struck the van from behind and from the side; ICE alleged the opposite.
The U.S. Attorney’s July 16 statement (opens in a new tab) offered a different, explicitly preliminary reconstruction. Aaron Reitz said preliminary information indicated that the driver shifted the van from reverse to forward while an officer was partly inside or immediately beside it. He did not repeat the initial ramming allegation and said his office drew no decisive conclusion while the investigation continued. His statement is evidence of the federal account, not a final finding that the shooting was justified.
Federal officials also publicized a white crystalline substance seen in the van while investigating possible drug offenses. The Harris County District Attorney’s Office later said laboratory testing was negative (opens in a new tab). That result bears on later portrayals of Salgado Araujo but does not determine whether the officer faced an imminent threat.
Rep. Sylvia Garcia called the shooting an outrageous abuse of government power and demanded an independent investigation in the September 1 Congressional Record (opens in a new tab). Reps. Al Green and Joaquin Castro also directly condemned the shooting at a July 24 oversight forum. Harris County District Attorney Sean Teare said federal agencies had not provided all requested evidence and announced a grand-jury inquiry. José Trinidad Rojas Pliego appeared in the grand-jury area on September 16 (opens in a new tab). As of September 22, no public indictment, no-bill or other final determination had been announced.
The available record does not publicly establish the van’s exact position and movement at the instant of the shot, the shooting officer’s precise location, or whether the officer was partly inside the van.
