According to Border Report (opens in a new tab), ICE arrested Ochoa Briseño and she was removed to Reynosa, Mexico, on Sept. 21. Luis Ochoa told the outlet that she was arrested at 5 a.m. outside Carmelita's Restaurant in Alamo, where she worked as a cook. KRGV reported (opens in a new tab) that she had spoken to the station after her son's Sept. 11 arrest and that an ICE official confirmed her arrest. Ten days separated the two arrests.
In a report KRGV published (opens in a new tab) on Sept. 16, five days before her arrest, Ochoa Briseño said that watching the video of her son's arrest was hard and that justice must be served against the officers she said beat the two teenagers.
Border Report reported that Luis Ochoa posted about his arrest on social media. He told the outlet that ICE detained his mother because of "the Facebook post" and because the family is bringing lawsuits. He also said that during his own arrest on Sept. 11 agents told the two teenagers to stay quiet or they would pick up relatives who did not have papers. Border Report reported that attorney Carlos Moctezuma Garcia believes she was picked up as retaliation for her family speaking out against ICE raids. Garcia told the outlet that the timing was too big a coincidence to believe and that he sees the arrest as a message from ICE about what happens to people who speak out. The reports we reviewed do not include a response from DHS or ICE to the alleged statement by agents on Sept. 11.
DHS told Border Report that ICE arrested Ochoa Briseño during a targeted operation, that she repeatedly refused lawful commands and that she was issued a final order of removal. It also said she entered the country by crossing the Rio Grande around June 2025, received a voluntary return on July 13, 2025 and reentered at an unknown time and place. In a statement that KRGV published, ICE said she had been removed on July 13, 2025 after a voluntary return that followed a July 11, 2025 local arrest for assault causing bodily harm to a family member, and that she was served an order of expedited removal on Sept. 21. DHS called it a final order of removal; ICE called it an order of expedited removal. The reports we reviewed do not say how the July 2025 charge was resolved. Luis Ochoa told Border Report that CBP asked his mother to return voluntarily and that she refused.
KRGV reported that ICE has not said whether the deportation was connected to the video of her son's arrest. As of Sept. 25 we could not locate the Sept. 21 order, a record of her 2025 return, a filed lawsuit by the family, or a DHS or ICE statement that directly answers the retaliation allegation. The public record does not establish why ICE chose to arrest her on Sept. 21.
