Overview

California's utilities commission accepted its BEAD award while reserving objections to conditions limiting broadband regulation. NTIA says the award terms constitute the agreement and the commission's letter does not modify it. The dispute concerns the effect and legality of Condition 50.

Read the full background

Condition 50 requires non-enforcement of specified broadband rules against participating providers and affiliates statewide, including outside BEAD projects. NTIA argues those rules threaten deployment and providers' finances. CPUC says it cannot waive mandatory legal duties or bind other California enforcement authorities. Its letter says it will execute subgrant agreements if and when disagreements are resolved and other applicable conditions are met. Stanford law professor Barbara van Schewick told Ars Technica that the letter preserves California's arguments but does not change the award terms.
