Overview

The August 5 final judgment (opens in a new tab) barred enforcement of specified NFA provisions against defined plaintiffs and, where applicable, their members and customers. The court entered judgment on Congress's enumerated powers after the making and transfer tax was reduced to zero. The plaintiffs' Second Amendment claims were dismissed without prejudice as abandoned.

ATF's October 9 guidance (opens in a new tab) extends non-enforcement nationwide as an agency policy. It leaves the $200 tax on machine guns and destructive devices in place. Gun Control Act requirements, including dealer background checks and transaction records where applicable, continue to apply, as do state and local laws. The guidance is not a repeal of the NFA.

The NRA (opens in a new tab) credits the change to legislation and litigation. SAF (opens in a new tab) praises it while continuing to seek a permanent legal solution. Everytown (opens in a new tab) says the enforcement decision puts communities at risk.
