Cory Booker says the ban “clearly” violates the Constitution and “has no regard for the First Amendment”

Cory BookerU.S. senator from New Jersey, interviewed on NBC’s Meet the Press

Asked on NBC’s Meet the Press whether the ban on CNN, MS NOW and Politico violates the Constitution, Sen. Cory Booker said “It clearly does.” He said he was also troubled that Trump is using the Justice Department “to persecute reporters,” pointed to investigations of reporters that he said followed an incident involving a Qatar Airways plane and were withdrawn after a federal judge said he would sanction the department, and said “this precedent has no regard for the First Amendment” and the ban “just doubles down on that.”

“It clearly does. What bothers me is not only this violation of the Constitution, but remember, in unprecedented ways he’s using his Justice Department to persecute reporters. He’s basically said, “If you break stories on me I don’t like, my Justice Department is going to investigate you.” In fact, look at what he did after the Qatar Airway, that sort of, I call it, cowardice retreat from the airplane, where he escaped in a dining car. Immediately, they started launching investigations against those reporters, so much so, that a federal judge said he was going to sanction the Justice Department, and they quickly withdrew. So this precedent has no regard for the First Amendment. He’s going after reporters, and this ban just doubles down on that.”

Where this statement fits

Should President Trump bar CNN, MS NOW and Politico from the White House over their coverage?

On Friday, September 18, 2026, President Donald Trump posted on Truth Social that, "effective immediately, I am banning" CNN, MS NOW and Politico "from the White House as a result of their constant 'reporting' FAKE NEWS!" About an hour later, in the Oval Office, he said no particular story prompted the decision, that he does not want the outlets "in my office," and that "somebody has a right to keep them away" if outlets write false stories. The three outlets and press-freedom groups oppose the exclusion, citing constitutional protection for the press, and the White House Correspondents' Association said it "stands in defense of our colleagues at CNN, MSNOW, and POLITICO." On Saturday, September 19, MS NOW, CNN and Politico said their White House reporters were refused entry and had press passes confiscated; the White House referred questions to Trump's earlier remarks. The dispute is over whether President Trump should exclude named news organizations from White House access over what they report.

Before the quotation

Host Kristen Welker had just interviewed Sen. John Barrasso. She opened with Booker by asking for his “reaction to this ban by the Trump administration of three major news outlets” and whether he thought “it violates the Constitution.”

After the quotation

Welker then moved on to the Democratic Party’s image and the midterms. The claims about Justice Department investigations of reporters and a federal judge’s threatened sanctions are Booker’s own; we did not verify them. The sentence in quotation marks that Booker attributes to Trump is Booker’s paraphrase, not a Trump quotation.

How this statement is classified

Condemned

The label describes this statement's response within the context above.

Why this label?

On Trump’s decision to exclude CNN, MS NOW and Politico from White House access because of their coverage, Booker answers “It clearly does” to whether the ban violates the Constitution and says the ban “just doubles down” on Trump going after reporters. That is an express denunciation of the exclusion itself. The closest competing label is “Challenged the characterization”, which loses because he criticizes the action rather than only disputing how it is described.

Carrera warns that the inquiry can deter press protests before any judgment

Jorge Carrera Domenech

“Según su portavoz, los boicots colectivos entre competidores pueden infringir la ley. Es una tesis que algún tribunal tendrá que examinar, y no es este el lugar para resolverla. Pero el mensaje no necesita sentencia para producir efecto. La próxima redacción que se plantee no cubrir un acto en protesta por el trato dado a otra sabrá que antes debe calcular cuánto cuesta contestar a un requerimiento del Departamento de Justicia.”
