Why we used this label
The reference point is whether ICE agents falsified records and testimony to justify the arrests of Almonte and Concepcion. Dworkin contrasts the government's statement that Concepcion "was NOT arrested by ICE" with the ruling, which he says "says otherwise, by name." That treats the government's account as false, so we labeled it Condemned. The closest competing label is Challenged characterization, which would fit a dispute over wording alone; he faults the government's account of the arrest.
